The Court of Appeal sitting in Ibadan today 3/2/2023 dismissed the appeal filed by Kenny Bello in Appeal No. CA/IB/542/2022 between Mr kehinde Ayodeji Bello Vs Independent National Electorial Commission & 3 Ors for lacking in merit.
The three justices of the appellate court while concuring with Chief Wale Liady, Hon. Attacker's lawyer held that it has become notorious base on plethura of authorities that the State Executive Committee of any political party do not have power to conduct primary elections under the law. Mr. Kenny Bello had approached Federal High Court on the 10/06/2022 to challenge the nomination of Rt. Hon Abdel-Majeed Adesegun aa the Candidate of PDP for House of Representatives.....
The trial court on the basis of preliminary objections of the defence counsel dismissed the matter. Peeved by the judgment of the trial court, the Appellant, Kenny Bello appealed to the Court of Appeal, Ibadan Division.
However, the appellate court today held that the trial court was right to have held:
1) that the State Executive Committee of Ogun State cannot conduct a valid primary;
2) that Mr. Kenyy Bello having participated in the primary elections conducted by the state exco has no locus standi; and finally
3) that the suit is statute barred having been filed more than 14 days the event his complaining about happened.
The Court of Appeal there after affirmed the trial court judgment.
